Terms of Use

Effective date: November 5, 2026

These Terms of Use ("Terms") are an agreement between you and the George W. Donaghey Foundation ("the Foundation," "we," "us"), a 501(c)(3) charitable organization (EIN 71-0201619) in Little Rock, Arkansas. They cover our website, donagheyfoundation.org, and our student profile site, profile.donagheyfoundation.org (together, "our sites"), and the emails and text messages we send through them.

By using our sites, creating a profile, or submitting a form, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use our sites.

Questions about these Terms: hello@donagheyfoundation.org.

1. Who can use our sites

  • You must be at least 13 years old to create a profile or submit a form. If you're under 13, please don't give us any information.
  • If you're under 18, please read these Terms with a parent or guardian. By creating a profile, you confirm that you've done so, or that you're old enough to agree on your own.
  • Anyone can read the website. A profile is for students considering the Donaghey Scholars program and is for your own personal use.

2. The Foundation, UA Little Rock, and your application

The Foundation and UA Little Rock are separate organizations. The Foundation funds the Donaghey Scholarship Program. The University of Arkansas at Little Rock runs the Donaghey Scholars Honors Program, admits students, reviews applications, and selects scholars.

  • A profile is not an application. Creating a profile, finishing its steps, or receiving our reminders doesn't apply you to UA Little Rock or the Donaghey Scholars program. You must apply to UA Little Rock directly, by its deadlines.
  • Nothing on our sites guarantees admission or an award. Eligibility, requirements, award amounts, and deadlines are set by UA Little Rock and the program, and they can change. If anything on our sites differs from UA Little Rock's official information, UA Little Rock's official information controls.
  • Check key dates yourself. We work to keep deadlines and requirements accurate, but we can't promise they are complete, current, or error-free, or that every reminder will arrive. You are responsible for meeting every application deadline and requirement.
  • Our sites give general information, not personal advice. Content about scholarships, financial aid, admission, or study abroad isn't professional, legal, or financial advice for your situation.

3. Your profile

  • Give accurate information and keep it up to date. You can change your answers on your profile page.
  • One profile per student. Don't create a profile for someone else or pretend to be another person.
  • Keep your sign-in links and codes to yourself. We sign you in with links and codes sent to your email instead of passwords. Anyone who can read your email may be able to reach your profile, so keep your email account secure. Tell us right away at hello@donagheyfoundation.org if you think someone else has used your profile.
  • Our staff may use your profile to support you, as our Privacy Policy describes, including adding notes and following up with you about the program.
  • You can stop at any time. You can tell us from your profile page that you're no longer interested, or email us to delete your profile.

4. Emails

When you create a profile, we'll email you about your profile and the Donaghey Scholars program, including steps, deadlines, and sign-in links and codes. You can unsubscribe from program emails with the link in any email. We'll still send sign-in links and codes you ask for, and messages about your profile or these Terms.

Parent or guardian email. If you give us a parent or guardian's email, you confirm they agreed to receive key dates and deadlines from us. They can unsubscribe at any time.

5. Text messages

Program: Donaghey Scholars deadline reminders, sent by the George W. Donaghey Foundation.

  • What you'll get: reminders about Donaghey Scholars deadlines and your next steps.
  • How you join: by checking "Text me deadline reminders" on your profile. Agreeing to texts is optional and isn't required to create a profile, apply, or receive any award. We don't send texts until you've confirmed your email address.
  • How often: message frequency varies, usually a few messages a month around key dates.
  • Cost: message and data rates may apply. We don't charge for texts.
  • To stop, reply STOP to any message. You'll get one message confirming you're unsubscribed, and then no more texts. You can also ask us by email. Reply START to resume.
  • For help, reply HELP or email hello@donagheyfoundation.org.
  • Your number: only give us a mobile number that is yours or that you're allowed to use. If you change or give up that number, update your profile or reply STOP, so we don't text the next owner.
  • Carriers are not liable for delayed or undelivered messages. Delivery isn't guaranteed and may depend on your carrier and device.
  • Privacy: we don't sell, rent, or share your mobile number or text-messaging consent with third parties or affiliates for their marketing. See our Privacy Policy.

6. Content you submit

This section covers anything you send us through our sites, such as an alumni archive entry, a Scholar Spotlight, a bio, or a photo ("your content").

  • You keep ownership of your content.
  • You give us permission to use it. You grant the Foundation a non-exclusive, royalty-free, worldwide license to use, copy, publish, display, edit for length, clarity, and style, and share your content, including your name, story, and photo, on our sites, in our social media, newsletters, and reports, and in other materials that promote the Foundation and the Donaghey Scholars program. This permission continues until you ask us to remove the content, as described below, except for printed materials and posts already shared before you asked.
  • We don't publish your email address or phone number.
  • You confirm that you have the right to share your content, that it's accurate, and that anyone else who appears in your photo agreed to its use. Don't submit content that belongs to someone else, such as a professional photo you don't have permission to share.
  • We decide what to publish. We may edit, decline, or remove any content at any time, for any reason.
  • To change or remove your entry, email hello@donagheyfoundation.org. We'll update it or take it down from our sites within a reasonable time. Copies that others have saved or reposted may remain.

7. Acceptable use

When using our sites, don't:

  • Give false information, or use our sites for anyone other than yourself.
  • Try to see or change information that isn't yours, or get into our systems, staff tools, or other people's profiles.
  • Interfere with, overload, or disrupt our sites, or get around their security features, such as bot checks or sign-in limits.
  • Use bots, scrapers, or other automated tools to access, copy, or collect information from our sites, except search engines that follow our robots.txt.
  • Upload viruses or other harmful code.
  • Submit anything unlawful, harassing, hateful, sexually explicit, or misleading, or that violates someone else's rights or privacy.
  • Use our sites to advertise, sell, or spam.
  • Use our sites in any way that breaks the law.

8. Our content and name

Our sites and their content, including text, design, graphics, logos, and photos, belong to the Foundation or the people who licensed them to us, and are protected by copyright and trademark law. You may view, print, and share pages for your own personal, noncommercial use, such as showing a parent or counselor. Don't otherwise copy, change, or republish our content without our written permission. "Donaghey," "Donaghey Foundation," and "Donaghey Scholars," and our logos, may not be used in a way that suggests we endorse you or your product.

Copyright concerns. If you believe something on our sites infringes your copyright, email hello@donagheyfoundation.org with a description of the work, where it appears on our sites, and your contact information. We'll review it and remove material when appropriate.

9. Links to other websites

Our sites link to other websites, including UA Little Rock's application pages. We don't control those sites and aren't responsible for their content, policies, or availability. Their own terms and privacy policies apply.

10. Privacy

Our Privacy Policy explains what we collect, how we use it, and your choices. It is part of these Terms.

11. Disclaimers

Our sites, emails, and text messages are provided "as is" and "as available." To the fullest extent the law allows, the Foundation makes no warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We don't promise that our sites will always be available, secure, or free of errors, or that any reminder will be sent or received on time.

12. Limitation of liability

To the fullest extent the law allows:

  • The Foundation, its trustees, officers, staff, volunteers, and service providers won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost opportunity, missed deadline, scholarship, admission, or financial aid, arising from your use of our sites, emails, or text messages, or from relying on any information on them.
  • Our total liability for any claim relating to our sites is limited to one hundred U.S. dollars ($100).

Some places don't allow some of these limits, so they may not all apply to you. Nothing in these Terms limits liability that can't be limited by law.

13. Your responsibility

If you're 18 or older, you agree to cover the Foundation's reasonable costs, including legal fees, from any claim by someone else that arises from content you submit or from your breaking these Terms or the law.

14. Suspending or ending access

We may suspend or delete a profile, remove content, or block access to our sites if we believe someone has broken these Terms, to protect our users or our sites, or if we stop offering a service. You may stop using our sites at any time and ask us to delete your profile. Sections 2, 6, and 8 through 17 continue to apply after your access ends.

15. Disputes and governing law

  • Talk to us first. If you have a concern, email hello@donagheyfoundation.org. Most problems can be resolved quickly and informally, and we'll try to do so within 30 days.
  • Arkansas law governs these Terms, without regard to its conflict-of-law rules.
  • Any lawsuit about these Terms or our sites must be brought in the state or federal courts located in Pulaski County, Arkansas, and you and the Foundation agree to those courts' jurisdiction.

16. Changes to these Terms

We may update these Terms from time to time. We'll post the new version here and change the effective date. If a change significantly affects your profile or text messages, we'll also tell you by email. If you keep using our sites after a change takes effect, you accept the updated Terms.

17. General

  • These Terms and our Privacy Policy are the whole agreement between you and the Foundation about our sites.
  • If any part of these Terms can't be enforced, the rest still applies.
  • If we don't enforce a part of these Terms right away, we haven't given up the right to enforce it later.
  • You may not transfer your rights under these Terms. We may transfer ours to an organization that takes over running our sites.
  • Nothing in these Terms limits any rights you have by law that can't be waived.
